This Privacy Policy of Wendr, LLC, a Delaware limited liability company (“Wendr”), was most recently updated on September 29, 2011.

Wendr knows that you care about how your personal information is collected, used and shared. We take your privacy seriously.

This Privacy Policy sets forth how Wendr collects, uses and protects personally identifiable information (“Personal Information”) shared by users of the website located at wendr.com (the “Website”) and the services, content, applications or other functionality offered by Wendr (collectively with the Website, the “Service”). By accessing the Website or using the Service in any manner you are accepting the terms of this Privacy Policy.

INFORMATION COLLECTION

Personal Information. Wendr collects and stores information you disclose while registering for or using the Service or provide to us in any other way. This may include but is not limited to your name, birthday, sex, email address, telephone number, BlackBerry Messenger pin, location, usernames for third party services (such as Twitter, Facebook, Foursquare, Google +, Google Chat, Skype) and information pertaining to your use of the Service. You may create a personal profile, interact with other users, form and/or join “crews”, perform searches and transmit information through various channels. We collect and store this information and may use the information as you interact with the Service and as otherwise set forth in this Privacy Policy. When users update information, we keep a backup copy of the prior version for a reasonable period of time.

Wendr may use your name, email address, and/or phone number to send you notifications regarding the Service, including but not limited to announcements, alerts regarding postings by other users or Service-related notifications. If you do not wish to receive certain notifications via email, phone or other communications from Wendr, you can indicate this preference in your privacy settings.

Personal Information such as your name and email address may be provided by users who wish to invite you to join the Wendr community. This information will not be visible to third parties and will be used solely for purposes of the invitation unless and until you join Wendr.

Non-Personal Information. Like many websites, we collect the browser type, IP address and location of all Website visitors. We also store certain information from users’ browsers using cookies (small pieces of data stored on the user's computer) and use cookies to confirm that a user is logged in and to tell us how and when the Website is visited. This information is used in the aggregate to help us understand how our Service is used. Our cookies do not store your Personal Information. Cookies can be blocked or removed by a user through the settings on most browsers. We treat this data as non-Personal Information except where otherwise required by law. We may also use third party analytics tools such as Google Analytics to obtain non-personal information that is used in the aggregate to help us understand how our Service is used.

INFORMATION SECURITY

Wendr takes reasonable precautions to protect user information, including locating account information on a secured server behind a firewall. Sensitive information (such as passwords), is encrypted using secure socket layer technology (SSL). However, no security measures are perfect or impenetrable. We therefore cannot and do not guarantee that information you provide through the Service will not be viewed by unauthorized persons. We are not responsible for circumvention of any privacy settings or security measures. You understand and acknowledge that, even after removal, copies of infomration may remain viewable in cached and archived pages or if other users have copied or stored the information. Because email and instant messaging are not recognized as secure communications, we request that you not send sensitive information to us by email or instant messaging services.

SHARING OF INFORMATION

Among Users. The Service is designed to help account holders share information with others. By default, your name and email address are available for purposes of searching by users of the Service. Other information is shared only with your “friends” or members of your “crews”. By default, this information includes your name, picture, website, city of residence, location and bio description. Your “plans” are shared only with the friends or crews you select. All sharing of information is done at your own risk, and individuals may disclose this information to third parties without Wendr’s control. You can control the information you share through your privacy settings.

With Third Parties. Wendr does not rent or sell your Personal Information to anyone without your permission. We do not share your Personal Information with third parties unless Wendr believes such sharing is 1) reasonably necessary to offer the Service, 2) authorized by the user or 3) required by law.

We may provide information to third party service providers such as server hosts, data management companies and search engines (“Agents”) in order to facilitate the operation of the Service. These Agents may be granted temporary access to Personal Information in order to perform these services. Wendr takes reasoanble measures, including contractual protections, to limit the use of Personal Information by Agents to the specific purpose for which it is reasonably necessary.

Wendr complies with judicial requests for Personal Information, account information, and other information and makes other legally required disclosures, provided that Wendr does not reveal such information unless and until we believe in good faith that the request therefor meets applicable legal standards. Additionally, we may share account or other information when we believe it is necessary to protect our interests or property, to prevent fraud or other illegal activity perpetrated through the Service, or to prevent imminent bodily harm. This may include sharing information with other companies, lawyers, agents or government agencies.

Information that you choose to provide through certain features of the Service may be published on the Website, which may be indexed by third party search engines.

Advertisers. Third party advertisers have no access to your Personal Information unless you choose to share it with them. This Privacy Policy does not cover the use of cookies or other tracking technologies by advertisers. Third party advertisers may serve advertisements that appear on the Website directly to users and, in so doing, automatically receive a user’s IP address. Third party advertisers may also download cookies to your computer, or use other technologies such as JavaScript and "web beacons" (also known as "1x1 gifs") to measure the effectiveness of their ads and to personalize advertising content. Doing this allows the advertising network to recognize your computer each time they send you an advertisement in order to measure the effectiveness of their ads and to personalize advertising content. Wendr does not have access to or control of the cookies that may be placed by the third party advertisers.

CHANGE OF CONTROL

In the event the ownership of all or substantially all of Wendr’s business changes, user Personal Information may be transferred to Wendr’s new owner(s). In any such transfer of information, your user information woud remain subject to the promises made in any pre-existing Privacy Policy.

OTHER WEBSITES

The Website and information posted thereon may contain links to other websites. We are not responsible for the privacy practices of other web sites. This Privacy Policy applies solely to Wendr and does not apply to information provided to any other website.

AGE RESTRICTIONS

The Service is intended solely for users who are thirteen (13) years of age or older. Any registration by, use of or access to the Service by anyone under 13 is unauthorized, unlicensed and in violation of the Terms of Service. By using the Service, users represent and warrant that they are age 13 or older. Users who are age 13 or older and below eighteen (18) years of age are permitted to use or access the Website only with the consent of their parents or guardians and represent and warrant that their access is with such parental consent.

Children under the age of 13 are prohibited from registering on the Service and Wendr does not knowingly collect or solicit personal information from anyone under the age of 13. If you are under 13, please do not attempt to register for the Service or send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 may provide any personal information to or on the Service. In the event that we learn that we have collected personal information from a child under age 13, we will delete that information as quickly as possible. DELETING INFORMATION OR YOUR ACCOUNT

You may delete your account at any time through your account settings. When Personal Information or your account is deleted, it will be prompty removed from the active Website. This information will be subsequently deleted from Wendr’s servers, though this process may take up to 30 business days to complete. During this period, your information may remain on backup media. Non-personal information may be retained by Wendr.

NOTICES AND REVISIONS

Wendr reserves the right to change its Privacy Policy at any time. Non-material changes and clarifications will take effect immediately, and material changes will take effect within 30 days of their posting on the Website. If we make changes, we will post them and will indicate at the top of this page the policy's new effective date. If we make material changes to this policy, we will notify you here, by email, or through notice on our home page. Unless stated otherwise, our current Privacy Policy applies to all information that we have about you and your account.

By using the Service, you are consenting to have your personal data transferred and processed in the United States, subject to United States law.
